Continuation of NY benefits in Florida..

Employed in NY from 1 July 2008 – 30 March 2009. Collected benefits from NY up until August 2009. Employed in Florida from August 2009 – February 2010.

As the NY rate is higher, I have re-opened by already opened NY claim and have now begun re-receiving NY benefits. However, this claim ends in March.

Question: With the above information, do I have enough work time in NY to open another claim in NY or will I just have to settle with a Florida claim once my NY claims ends in March?

Can I change my Florida Benefits to NY?

Hi,
I am in the same situation except for the other way around! I worked in Florida from May 2006-Feburary 2010. I filed for unemployment in Florida Feb 2010 and received benefits for 1 month, found a job in NYC March 2010 and was just let go September 2010. I didn’t realize my claim was still open in Florida (I am new at this)so I filed for NY unemployment, I got a notice stating my claim was denied because I didn’t work at least 2 calendar quarters in NY, but as soon as September is over July-Sep quarter will show = 2 quarters. Can I change my claim from Florida to NY now? Or do I have to wait until my unemployment benefits are up in Florida?

If you have an existing claim in Florida .. that would be the one to reopen .. and I’m not certain why NY wasn’t made aware that you have an existing claim .. but go online to Florida’s website and do that.

Most people are new to unemployment claims .. it’s not like it’s a valuable life goal to be unemployed, but it is valuable to understand how it works .. in case of emergencies:)

Follow-up to florida/NY continuation…

Current claim for benefits per web-page ends 21 March. So, when do you recommend I re-submit my claim in order to insure continuation of NY benefits?

Hi,

I can’t say for sure. The reason is that NY also has an alternative base period they might have used in your case.

I do know that to qualify for a “second benefit year” in NY you must have earned at least 5 times your WBA to monetarily qualify. I also know that NY requires that you earned the money in NY to collect NY benefits.

I also know that Florida does not have an alternative base period.

My suggestion .. try in NY first and if they have a problem with it .. they’ll tell you that you need to file in Florida.

NY is the state that denies the claims of “telecommuters” living in FL working for NY employers because NY doesn’t require their employers to pay UI tax on their wages because they are not physically working in NY .. even though they are being paid out of NY and no one is paying UI taxes in Florida either.

So although my suggestion is that you first try NY .. because I don’t know if you have any “lag period of wages” unused in NY .. I’ll make a bet if you don’t .. Florida will be your only option.

My benefit year ending date per NY dept of labor on-line tool is 21 March. So, I will “re-file” my claim as soon as I am able – ie 22 March.

So, if I do this, will it be possible to maitain NY unemployment?
