Can I get unemployment if I have been fired is a common question about getting fired. It’s been asked many times below in the list of Q&As. And not only after someone was fired from a job, but after also being initially denied unemployment, or denied after a tribunal unemployment appeal hearing.
If there is one tip I think could work just as well for employees as it does for employers, it’s that managing the outcome of an unemployment claim is an individual process and literally based on logical comprehension of the same elements an unemployment department is supposed to be looking for when they initially adjudicate each based upon the available information to arrive at the initial determination.
The Issue is About Proving Work Related Misconduct Or Rebutting It Was Something Other Than Work Misconduct
It’s easy to appeal an initial determination so you can have your day in court, so to speak, even if unemployment is administrative law and hearings are often held over the phone in a majority of states.
But not being prepared to put forth a relevant argument on the issue of misconduct .. with the props (evidence and witnesses) a personn may need to win, is often caused when claimants underestimate the importance of a tribunal unemployment appeal hearing, or mistaking a second level appeal to a board of review .. as a second chance.
So, before heading down to the Q&As about getting fired, why not read the first real court definition written about work misconduct, that is accepted, all, or in part, by more states than Wisconsin.
Trust me, it’s best to read it before an employer is assigned the burden of proof they are responsible for proving and you are responsible for rebutting .. quasi-legally at a lower level tribunal appeal hearing and before you decide to use a comment form to ask a similar question to the one that began each thread of Q&As.
Common Reasons Employers Use to Terminate Employment
Although the reasons can be refined by a specific rule, or policy in an employee handbook, the list of common causes for terminating employment isn’t that long that most employee tend not to focus on when they first asked the question about unemployment benefits when fired. It’s important to focus on how and what the employer will be trying to prove, so you can see chinks in the burden they must meet, when you offer rebuttal either during the initial determination phase, or the first and last unemployment appeal level the unemployment department uses to establish a record of facts .. for any further appeal.
