So I’ve been attending school full time for the last 2 years while working full time. I am pretty sure I am going to be layed off soon. Now I’m worried that I won’t be able to collect unemployment because I am attending school, even though I have been doing both school and work for the last 2 years. Do you think I would be denied? Or do you think I may have more of a chance since I have set a precedent of working full time while going to school?
Hi Ryan,
That is precisely the right question to ask.
And the issue of whether a state will deny benefits on an able and available issue is state specific.
I always .. always check the USDOL comparison of state laws first. It’s table 5-12 in the Nonmonetary Eligibility chartbook.
We can all access it by clicking the current year on this page at the USDOL and it’s a good starting place no matter what state you need to collect from .. as far as common issues go.
It is the second column “disqualified or ineligible while attending school that’s truly important ..
It is possible in Texas to collect unemployment while attending school, but pay close attention to what would be required of you in order to collect.
