Is a forced resignation Good cause to quit?
My employer called me to his office and said I had two options. I could be fired that day, or resign effective the end of the year. I chose the later of the two. Prior to this time, I had received notice that my productivity had fallen off. I was called into his office in mid December.
My state of employment is NY. Can I receive UI benefits?
Hi Lester,
The first thing you might notice is that I changed your question to more appropriately show what you are actually asking about.
A forced resignation should be adjudicated as a discharge by the unemployment department.
The question always on the tip of my finger when I am asked about this is .. did you manage to get the “conversation” documented .. such as in a “tell all resignation letter”.
Then .. if you did .. move on to figure out whether the forced resignation was precipitated by a valid reason to discharge you .. which would be workplace MISCONDUCT as explained by NY.
