hello I just separated from military and was collecting unemployment. Applied for a warehouse job. I have never done that type of work and my manager says that the way I am going I will not pass my 90 day probation. If I am let go can I still continue to collect my U/I benefits? I am trying my best but never worked in warehouse before. I have sent in 2 claims forms and stated that I am working. Benefits were cut my over half. Would I still be able to collect if I am let go before my 90day probation?
John,
You should eventually be able to collect again if you are fired for performance before your probation period is up.
I’m sure the UI dept. will have to investigate though and sometimes, this takes time.
Poor performance does not necessarily equate to misconduct. Inability or inexperience is not willful misconduct, whereas an attitude of neglectfulness can be and usually concerns performance issues.
Please use the CA benefit determination guide to review what the state has to say about this.
