OK FIRST OF ALL I WORKED FOR A PRINTING COMPANY I WAS A MACHINE OPERATOR ON DECEMBER 2009 I WAS GIVING A WRITE UP BECAUSE SOME BAD BOOKS WENT OUT TO THE CUSTOMER AND THIS ISSUE COST THE COMPANY MONEY SO ON THIS WRITE UP I WAS TOLD MY WORK WILL BE MONITOR FOR 45 DAYS AND “ANY VIOLATIONS WILL HAVE REPERCUSSION FROM SUSPENSION TO OTHER MEANS OF DISCIPLINE INCLUDING DEMOTIONS OR TERMINATIONS” ON APRIL 2010 I HAD 2 MORE WORK PERFORMANCE WRITE UP’S HOWEVER I DID NOT RECIEVE A SUSPENSION,DEMOTION OR TERMINATION ON THIS 2 APRIL WRITE UP’S ALSO MY 45 DAYS HAD PASSED AND THERE WHERE NO COMPANY COST. THIS 2 APRIL WRITE UPS ALSO DIDN’T INDICATE ANYTHING ABOUT MY WORK BEIGN IN JEOPARDY SOME OF THIS ISSUE’S I HAD WITH MY WORK PERFORMANCE WAS BECAUSE THE MACHINE’S NEEDED MAINTANCE AND THE EMPLOYER WAS AWARE OF IT.

I’m done answering work performance questions. There’s already a lot here and anything further I might have to add would only be after I know specific details and can then ask more questions.
As far as misconduct goes for work performance .. the employer must prove an element of negligence .. culpability, or “should have known better” vs. an inability to perform due to some other reason .. such as in Colorado .. lacking the mental ability or education to do a job.
